If you use franchise in the way i understand it, i think that is illegal. See eg:

http://europa.eu/rapid/press-release_IP-00-725_en.htm

Copyright, franchises, patents, trade-marks, license agrreeements, and such are all fodder for the legal beagles and probably beyond the comprehension of our non legal minds.

Maybe one of the reasons there seem to be more lawyers than engineers in Silicone Valley. ;)

To me it seems that generally the North American courts prefer to rule against trade restrictions whereas the EU courts seem to favour trade restrictions. A veritable minefield for international trade and free trade agreements.

Not judging, just saying! There are pros and cons to each viewpoint.

The EU rule i pointed to is only against discrimination against customers based on where they are from:

If you walked into a McDonalds somewhere in Europe, would you like not to be served because you are from Ireland ?

What if you lived in Scotland and your family name was MacDonald? With or without the farm :(

I seem to recall a case in Scotland many years ago on this very issue and the judge ruled in favour of Mr MacDonald. Of course one resatauant in one location in his home town. But it illustrates the bully-boy tactics of corporate lawyers.

"FIrst we kill all the lawyers" - William Shakespeare (and taken out of context

You're correct there. McDonalds is a trademark name like Kodak etc.

For Mr MacDonald one can also use the commonly accepted abbreviation Mr McDonald.

Such fun the English language.

@Roy Sletcher - I've eaten so often at MickeyD's over the years that I must own a restaurant. Well, at least paid for somebody else to have one.
Now the thing about gravy on fries in your part of the world... :idunno

Ah - The Quebec delicacy known as Poutine. Also includes cheese curds with the gravy and fries. Optional extras being a defibrillator on the side and anti-Chlo-restoral medication.

It is the dietary secret explaining why our hockey players are the best in the world. :(

Seriously, the McDo coffee in my area is the best of the fast food joint offerings. In parts of New England they serve Paul Newman's own. At least they used to, will have to check on my next trip.
